Most buyers think that the agent they are working with is working for them. But unless a buyer has hired an Exclusive Buyer’s Agent, the agent might actually represent the seller.
Here’s why:
A traditional agent works for sellers and represents their interests. Before the early 1980’s, all real estate agents worked for the seller. Buyers had no true representation. Homebuyers were “customers” of the seller.
Today, in addition to representing sellers, traditional agents can also work with buyers as either customers or clients.
Some traditional agents will still work in a non-agency relationship with buyers as customers (meaning that the agent really works for the seller). But many traditional agents offer to work in a dual-agency relationship with both a buyer and a seller in the same transaction. (More on this below.)
Most real estate agents are Traditional Agents!
A true Buyer’s Agent is an agent who assists a buyer as their agent in a transaction where the buyer’s agent and brokerage does not also represent the seller, thus giving 100% loyalty to the buyer in the transaction.
Many Traditional Agents promote themselves as “Buyer’s Agents” even though they may also list properties for sale and could therefore be unable to promise 100% loyalty in transactions involving those homes. Many traditional buyer agents work on a team under a Listing Agent who often works almost exclusively for sellers. This arrangement also creates conflicts of interest and can impact the agent's ability to represent you fairly.
Unless a property has already been identified, and that property is listed by a different agent and brokerage... or not listed at all... most Traditional Buyer’s Agents cannot promise 100% loyalty to a buyer throughout their transaction. Conflicts of interest will exist if you want to buy a home where "your" agent or broker already has legal obligations to the seller of that home and you will not be able to receive full representation!
An Exclusive Buyer’s Agent (EBA) is an agent who promises 100% loyalty to the buyer throughout their transaction. They can do this because an Exclusive Buyer’s Agent, and the company they work for, represent buyers only and do not list homes for sale. They are experts in representing the buyer's best interest from start to finish. Their loyalty is not to the seller, or to getting the deal to close, but to the buyer, 100% of the time.
Buyers who hire an EBA hire an agent who can commit 100% loyalty to the buyer and is under no obligation to any seller. They can promise this loyalty even before the search for any potential homes has begun because neither the agent nor the company represents home sellers as clients.

A Dual-Agent is an agent with obligations to both the seller and the buyer in the same transaction. Because of this, Neither party receives full representation.
Full representation includes undivided loyalty, confidentiality and disclosure of all material information known to the agent. These things are missing in a transaction where the agent or broker is a dual-agent.
Many brokerages prefer to call Dual-Agents by the less disparaging term “Limited Agent”. Others call them "facilitators." Regardless of what they are called, the loyalty of a dual agent is to neither the seller nor the buyer, but to the transaction, and they often believe their job is to keep the transaction together, which is not always in your best interest!
Consumer Reports has warned: "You can't have partial loyalty. An agent either works for you or works for someone else."
The ONLY way to make sure that your real estate agent will represent you and only you in your transaction is to hire an Exclusive Buyer's Agent! At Homebuyer Representation we are on YOUR side 100% of the time and we will never ask you to lower your level of representation because we don't list homes or represent sellers as clients!
Why a buyer should only... EVER... Hire an Exclusive Buyer's Agent
A buyer will get the highest level of representation only in an agency relationship. If you do not hire an agent on your side of the transaction, you are nothing more than a customer to the seller and their agent.
According to the National Association of Realtors, “As a customer, a buyer is not represented by an agent… the agent cannot negotiate on the buyer’s behalf nor reveal to the buyer any confidences of the client, the client is the seller.”
Without your own representation, you are just a customer of the seller and their agent. Their job is to sell you specific homes at the highest price and best terms for the sellers they represent. The loyalty of the agent is to the seller, not to you.
The second reason to hire an Exclusive Buyer’s Agent is to assure that your agent will represent you, and only you, and never the seller.
By signing a Buyer Agency Agreement with an Exclusive Buyer Brokerage, you establish a contractual relationship with the brokerage that makes the broker and the agent you are working with legally accountable to you.
However, IF you consider hiring a Buyer’s Agent from a company that also lists property, you will want to ask, and then document, IN WRITING, what happens if you want to buy a property listed for sale with that agent or if you are interested in a property listed by another agent in the same company. Some reputable companies will allow you to seek representation from a different brokerage whose loyalties will not be divided, but in order to protect their bottom line, most brokerages will tell you that you can just work with another agent in the same company. But this makes the broker a dual-agent and they will represent you at a lower level because they cannot help you in any way if it could be perceived as harming their other client, the seller.
What you need to do is find a competent Exclusive Buyer Brokerage to represent you.
Exclusive Buyer Brokerages do not list homes or represent sellers. This is the only way to be certain that you will be fully represented throughout your home search and purchase.
And BE AWARE! Many traditional brokerages use an agreement with buyers called an “Exclusive Buyer-Brokerage Agreement” (or similar). Make sure you thoroughly read this agreement! This title is misunderstood by the general public . Signing this form does not guarantee that you are hiring an Exclusive Buyer Brokerage. Many of these brokerages use the word “exclusive” in the title because it legally means that you are locked in with that brokerage exclusively. (Meaning they are the only brokerage you can work with until the agreement ends.)
A seller’s agent is legally obligated to get the most money and the best terms for the seller. There is absolutely nothing shady about this. That is what they were hired to do.
And can the seller's agent who was hired to work in the best interest of the seller also work in the best interest of the buyer? They cannot.
A seller’s agent, by law, must work in the best interest of their client. They must pass on any information they know about the buyers to the sellers. This includes information that may hurt your ability to get the home at a lower price or better terms.
Exclusive Buyers Agents do not work for sellers. We work for buyers only. We look out for YOUR best interest. An EBA will share with you any information they learn about the seller’s situation that could lead to a better outcome for you.
